OFFICIAL CONTEST RULES & REGULATIONS (“Official Rules”)

for

LCBO AND AEROPLAN SPRING ONLINE EXCLUSIVE CONTEST (“Contest”)

THE FOLLOWING CONTEST IS VALID ONLY IN ONTARIO. THIS CONTEST IS SUBJECT TO ALL APPLICABLE FEDERAL, PROVINCIAL AND MUNICIPAL LAWS AND IS VOID WHERE PROHIBITED BY LAW. SUBMISSION OF AN ENTRY CONSTITUTES FULL AND UNCONDITIONAL ACCEPTANCE OF THESE OFFICIAL RULES.

NO PURCHASE NECESSARY TO ENTER OR WIN. A PURCHASE WILL NOT INCREASE YOUR CHANCE OF WINNING. LIMIT OF ONE HUNDRED (100) ENTRIES PER PERSON DURING THE CONTEST PERIOD.

This Contest is brought to you by the Liquor Control Board of Ontario (“Contest Administrator”) and Aeroplan Inc. and Air Canada (collectively, the “Contest Sponsor”).

1.         CONTEST PERIOD

The Contest starts March 31, 2024, at 12:00 a.m. EDT and ends on April 27, 2024, at 11:59 pm EDT (hereinafter, the “Contest Period”).

2.         ELIGIBILITY

To be eligible for this Contest, you must be:

a.       a legal resident of Ontario;

b.       nineteen (19) years of age or older prior to the start of the Contest Period; and

c.       an Aeroplan member (an “Eligible Participant”).

For the Automatic Entry Method of Entry (see below), you must also be opted-in to receive promotional communications from Aeroplan. To opt-in, please visit https://www.aircanada.com/aeroplanprofile and select “Manage my Aeroplan email preferences”. Enrolment in the Aeroplan program is free. If you are not an Aeroplan member you can enroll on-line at https://www.aircanada.com/aeroplan/member/enrolment.

Directors, employees, representatives, or agents of the Contest Administrator and the Contest Sponsor, the Alcohol and Gaming Commission of Ontario (“AGCO”) and their respective subsidiaries and affiliates, media partners, advertising and promotional agencies, and members of the immediate family members of any of the aforementioned are not eligible to enter the Contest. For purposes of this Contest, “immediate family members” shall include the mother, father, brothers, sisters, daughters and sons (including step-half or adopted), partner or spouse of an individual (regardless of where any such “immediate family member” resides).

3.         HOW TO ENTER

No purchase necessary.

During the Contest Period, Eligible Participants can enter the Contest using one (1) of the following methods of entry (each, a “Method of Entry”):

a.       Automatic Entry

Eligible Participants who are opted-in to receive promotional communications from Aeroplan and spend $50.00 or more using (i) LCBO’s online store (www.lcbo.com), or (ii) the LCBO mobile application are automatically entered into the Contest (an “Automatic Entry”). $50 minimum purchase requirement excludes delivery, tax, container deposits, gift card purchases, charity donations and head office cheques.

 

If an Eligible Participant does not want to be automatically entered into the Contest, contact the LCBO with your name and Aeroplan number using one of the following methods with “SPRING ONLINE EXCLUSIVE CONTEST: DO NOT WISH TO PARTICIPATE” as the subject and the LCBO will remove any Automatic Entries you would have otherwise been eligible to earn in this Contest:

Each eligible transaction will be given one (1) Automatic Entry. Automatic Entries are only available while supplies last. If a product from the eligible transaction resulting in an Automatic Entry is returned or exchanged during the Contest Period, the impacted Entry will be forfeited and disqualified from entering the Contest.

b.      Mail-In Entry

Eligible Participants can enter the Contest by mailing a one hundred (100) word essay, in English or in French, about where they would like to travel, along with their name, address, e-mail address, telephone number, and Aeroplan membership number (“Mail-in Entry”) to the following address:

Only one (1) essay per envelope is permitted (the “Submission”). Each Mail-In Entry will be given one (1) Entry (as defined below) to the Contest. One Mail-In Entry will be given for each original essay in a Submission that meets the requirements outlined below. For the avoidance of doubt, duplicate essays by the same Eligible Participant will not be given additional Mail-In Entries. Mail-in Entries must be post-marked and received by the Contest Administrator at the above address before 11:59 p.m. EDT on April 27, 2024. The Contest Administrator takes no responsibility for any lost, stolen, delayed, illegible, damaged, misdirected, late or destroyed Mail-in Entries. Essays that are not an original creation of the Eligible Participant submitting it, or which are illegal, defamatory or in any way obscene, all as determined solely by the Contest Administrator, will be disqualified.

To be considered an eligible Mail-In Entry, all content and materials associated with your Submission must: (i) be submitted and received in accordance with these Official Rules during the applicable Contest Period; (ii) include all required components and materials noted above; and (iii) comply with these Official Rules, including, but not limited to, the General Terms and Conditions listed below for each Prize (as defined below), all as determined by the Contest Administrator in its sole and absolute discretion. By participating in this Contest, including, without limitation, by submitting a Mail-In Entry, you acknowledge and agree that you have read and agree to be legally bound by these Official Rules.

By entering the Contest, each Eligible Participant agrees that their Mail-in Entry complies with the Content Restrictions, as defined below, and that the Contest Administrator may choose to disqualify an Eligible Participant from the Contest if it believes, in its sole discretion, that the Mail-In Entry fails to comply with the following restrictions (collectively, the “Content Restrictions”):

         i.            written submissions and essays (each, a “Creative Work”) must not be illegal, defamatory, hateful or in any way obscene, or disparage Contest Administrator, Contest Sponsor or any other person or party;

       ii.            the Submission (including any Creative Work) must not contain material that is unlawful, in violation of or contrary to the laws or regulations of any jurisdiction where they are created, or that violates or infringes any third-party rights, including, but not limited to, copyright, trademark, privacy, publicity or any other intellectual property rights; and

     iii.            the Submission (including any Creative Work) must not be inconsistent with the image and values of Contest Administrator, Contest Sponsor or contrary to the purpose of the Contest.

By entering, each Eligible Participant warrants and represents the following with respect to the Submission:

         i.            that they are the sole and exclusive owner of any Creative Work forming part of the Submission;

       ii.            Creative Work must be an original creation of the Eligible Participant;

     iii.            the Submission (including any Creative Work) will not infringe on any rights of any third parties; and

     iv.            any third parties appearing in the Creative Work have given entrant appropriate consent to be photographed and used as permitted herein. Contest Administrator reserves the right to request releases from any third parties appearing in any Creative Work at any time.  Failure to produce third party releases upon Contest Administrator’s request may result in disqualification, as determined by Contest Administrator in its sole and absolute discretion.

All Mail-In Entries shall become the property of the Contest Administrator and none shall be returned.

 

4.         ENTRY REQUIREMENTS

a maximum of one HUNDRED (100) Entries per Eligible Participant is allowed during the Contest Period (regardless of the Method of Entry).

“Entry” means either an Automatic Entry or a Mail-in Entry. By submitting an Entry (regardless of the Method of Entry), the Eligible Participant agrees to be bound by the Official Rules and the decisions of the Contest Administrator, which are final with respect to all matters relating to the Contest.

If it is discovered by the Contest Administrator (using any evidence or other information made available to or otherwise discovered by the Contest Administrator) that any person has attempted to:

         i.            obtain more than the maximum allowable number of Entries during the Contest Period; or

       ii.            use (or attempt to use) multiple names, identities, email addresses and/or any automated, macro, script, robotic or other system(s) or program(s) to enter or otherwise participate in or disrupt this Contest,

then he/she may be disqualified from the Contest in the sole discretion of the Contest Administrator.

The Contest Administrator reserves the right, in its sole discretion, to require proof of identity and/or eligibility (in a form acceptable to the Contest Administrator including, without limitation, government issued photo identification):

i.                     for the purposes of verifying an Eligible Participant’s eligibility to participate in this Contest;

ii.                   for the purposes of verifying the eligibility or legitimacy of an Entry entered (or purportedly entered) for the purposes of this Contest; or

iii.                 for any other reason the Contest Administrator deems necessary, in its sole discretion, for the purposes of administering this Contest in accordance with these Official Rules.

Failure to provide such proof to the satisfaction of the Contest Administrator in a timely manner may result in disqualification of the Eligible Participant, in the sole discretion of the Contest Administrator.

The potential winner of the Prize (as defined below) may also be requested to provide the Contest Administrator with reasonable proof that he/she is the Authorized Account Holder of the Aeroplan membership associated with the winning Entry. In the event of a dispute regarding the identity of the person submitting an Entry, the Entry will be deemed to be submitted by the Authorized Account Holder in whose name the Aeroplan membership is registered, provided that person meets all other eligibility criteria of this Contest. “Authorized Account Holder” shall mean the natural person assigned to the Aeroplan membership number.

Note: Although online access and an email account may be required in order to participate in the Contest, no purchase is required. Many public libraries, Internet cafés, retail businesses and others offer free access to the Internet and a number of Internet service providers and other companies offer free email accounts. Standard data use and service rates apply and may vary according to your mobile device package and mobile service provider.

 

5.         PRIZE DESCRIPTION

There is one (1) grand prize (“Grand Prize”) available to be won. This is defined as the “Prize”.

a.       One Grand Prize

The Grand Prize shall consist of two (2) Economy Class, round-trip ticket(s) on any flight operated by Air Canada® (including, flights operated under the Air Canada Express® banner and operated by Air Canada Rouge®) from any Canadian Airport served by Air Canada to anywhere in the world that Air Canada flies. Estimated retail value of a Grand Prize is $5,800.00 CAD.

b.       Prize and Travel Terms and Conditions

No ground transportation is included in the Prize (including, but not limited to, ground transport to/from the airport).

Reservations for flights are subject to availability. See Appendix I for applicable blackout dates.

Travel must be booked, ticketed and travelled no later than twelve (12) months from the date upon which the recipient of the Prize is confirmed, or the Prize will be forfeited, without substitution, by the Prize winner and their guest(s). No changes permitted to reservations once date of travel is confirmed or ticket has been issued. The Prize winner and their guest must participate in all aspects of the Prize together (i.e. the Prize winner cannot have a different guest for different aspects of the Prize).

Travel in connection with the Prize does not qualify for Aeroplan points accumulation or for mileage/points accumulation in any other frequent flyer program.

The Prize winner and their guest(s) are responsible for:

i.                     any and all costs, expenses and taxes not expressly described herein including, without limitation, ground transportation, gratuities, merchandise, baggage charges, telephone calls, personal expenses of any nature for overnight layovers, meals and beverages, medical insurance, service charges, in-flight meals and entertainment;

ii.                   costs incurred to and from the departure point (as the Prize originates and terminates at such departure point);

iii.                 obtaining sufficient personal travel insurance prior to departure, if desired;

iv.                 any expenses, costs, gratuities, or taxes not specifically listed in the Prize description; and

v.                   obtaining and carrying all necessary travel documentation, such as passports and visas and complying with entry, health, safety, customs and immigrations regulations and requirements.

The use of upgrade certificates is not permitted for flights associated with the Prize. Use of the airfare tickets are subject to Air Canada’s general conditions of carriage publicly available at www.aircanada.com.

The Prize winner agrees and acknowledges that the Contest Administrator and Contest Sponsor will not be liable if any of the guest(s) or the Prize winner are denied boarding due to any failure to comply with applicable travel restrictions or requirements, or these Official Rules.

The Prize winner and their guest(s) understand and acknowledge the risks related to the spread of infectious or contagious diseases and understand that it remains their responsibility to take the necessary precautions applicable to any health hazards, including but not limited to COVID-19. Other mandatory safety protocols may apply based on the nature of the Prize. Availability of the services and facilities may be impacted.

Exact value of the Prize depends on point of departure and destination as well as time of travel. The Prize winner is not entitled to any difference between the actual retail value of the Prize, or any component thereof, and the approximate retail value outlined herein. Prize must be accepted as awarded and may not be sold, transferred or converted to cash and will not be refunded if unused. No substitutions, changes or extensions are permitted. Contest Administrator reserves the right, at its sole discretion, to substitute the Prize for one of equal or greater value or to allow a Prize transfer.

 

6.         WINNER SELECTION

A random draw from all Entries received from Eligible Participants during the Contest Period will be held 200-174 Spadina Avenue, Toronto ON M5T 2C2 on May 23, 2024 at 10 a.m. EDT in order to select the winners of the Prize.

The odds of winning a Prize will depend upon the total number of Entries received from Eligible Participants during the Contest Period.

Limit of one (1) Prize per person.

7.         CLAIMING OF PRIZE

In order to be declared a winner and be able to claim their Prize, the Eligible Participant selected as per these Official Rules (the “Selected Entrant”) will be contacted by telephone, e-mail, direct message or other form of notification sent to the coordinates accompanying the selected Entry used to submit the selected Entry (if applicable) and will be instructed on how to claim their Prize by the Contest Administrator, Contest Sponsor, or one of its agents or representatives, shortly following the draw and must confirm acceptance as Selected Entrant within three (3) calendar days of contact. Each Eligible Participant is solely responsible for ensuring their e-mail and Aeroplan account settings are set such that they are able to receive such notification messages from the Contest Administrator or Contest Sponsor.

If the Selected Entrant does not confirm acceptance within three (3) calendar days of contact by the Contest Administrator, the Selected Entrant will be automatically disqualified and forfeit all rights to the Prize. At its entire discretion, Contest Administrator may select another Eligible Participant among the Entries by way of random draw until the Prize(s) are successfully awarded or there are no more eligible Entries, whichever comes first. This process may continue until the Prize has been awarded or there is insufficient time to permit the awarding of the Prize. The Contest Administrator is not responsible, whether as a result of human error or otherwise, for any failure to contact a Selected Entrant.

Before being declared a Prize winner, each Selected Entrant will be required to: (i) successfully answer (without help) a time-limited, mathematical skill-testing question, and (ii) sign a declaration and release form confirming, without limitation, that:

·         they comply with the eligibility requirements;

·         they have read the Official Rules and comply completely;

·         they accept the Prize, as awarded;

·         they comply with any conditions/restrictions that may apply to the Prize;

·         they acknowledge the Contest Administrator and Contest Sponsor’s right to publish their picture, name and city of residence without compensation other than the Prize offered; and

·         they acknowledge the disclaimer of liability from the Contest Administrator, Contest Sponsor, AGCO and their respective parent, subsidiaries and affiliates, media partners, advertising, promotional agencies and each of the foregoing entities’ directors, officers, employees, contractors and agents.

Guest(s) of the Prize winner will also be required to sign a similar declaration form.

No correspondence will be undertaken except with the Selected Entrants whose Entry was drawn. Once a Selected Entrant is declared a Prize winner by the Contest Administrator, the Contest Administrator will send the Selected Entrant an email containing the details of how to redeem their Prize.

8.         GENERAL TERMS AND CONDITIONS

 

a.       CONTEST ADMINISTRATION

Eligible Participants agree to be bound by all decisions of the Contest Administrator and the Contest Sponsor regarding the Contest which shall be final and binding in all respects.

The Contest is subject to federal, provincial and local rules and regulations. Unless otherwise provided at law, all actions, proceedings or litigation relating hereto shall be adjudicated in the judicial district of Toronto, province of Ontario, and the parties consent to such exclusive venue and jurisdiction.

All Submissions and all information provided by Eligible Participants must be complete and accurate. The Contest Administrator will not be held responsible for any incorrect or inaccurate transcription of entry information, any error or technological malfunctions of any kind in connection with the Contest, telephone or internet interruptions and/or any late/incomplete/erroneously completed Prize claims or declaration forms or validly disqualifying any Eligible Participants or winner(s) in accordance with the terms hereof.

All Submissions are subject to verification by the Contest Administrator and may be disqualified if they are received outside of the Contest Period, are incomplete, illegible, irregular, photocopied or otherwise reproduced, submitted through illicit means or if they contain any false statements, or do not conform to or satisfy any condition of these Official Rules.

If the Contest is not capable of running as planned for any reason, including tampering, unauthorized intervention, fraud, technical failures, or any other cause, the Contest Administrator reserves the right, at its sole discretion, to, without advance notice, terminate or suspend the Contest, in whole or in part, or modify it in any way, without any further obligations to Eligible Participants. Furthermore, if the Contest Administrator determines, at its sole discretion, that any entry compromises the integrity of the Contest, the Contest Administrator reserves the right to disqualify the entry at issue or terminate the Contest in its entirety without any further obligations to Eligible Participants. The Contest Administrator further reserves the right, at its sole discretion, to disqualify any individual from the Contest, and/or to revoke, rescind, withhold or otherwise limit or restrict the Prize awarded to a winner, and/or to ban the individual from any future contest of the Contest Administrator who it finds or believes to be:

i.                     tampering with the entry process or the operation of the Contest;

ii.                   acting in violation of the Official Rules or in an unsportsmanlike or disruptive manner, or with intent to annoy, abuse, threaten or harass any other person;

iii.                 acting or involved in any situation or occurrence which brings them into public disrepute, contempt, scandal, or ridicule, or which shocks, insults, or offends the community or any group or class thereof, or to offend public morals and decency to or which reflects unfavourably upon the Contest Administrator, the Contest Sponsor, the AGCO, the Government of Ontario, and each of their respective parent, subsidiaries and affiliates, media partners, advertising and promotional agencies and each of the foregoing entities’ respective directors, officers, employees, agents, representatives, successors and assigns, or their respective products or services, as determined in the reasonable discretion of the Contest Administrator; or

iv.                 posting or making available to the public any post, picture, video, statement, or any other content of any form on any media (including any social media platform) mentioning, tagging, alluding to, or associating itself in any way with the Contest and/or the Prize which, in the reasonable discretion of the Contest Administrator, infringes or otherwise violates the rights of the Contest Administrator, the Contest Sponsor, AGCO, the Government of Ontario, and each of their respective parent, subsidiaries and affiliates, media partners, advertising and promotional agencies and each of the foregoing entities’ respective directors, officers, employees, agents, representatives, successors and assigns.

 

b.      LIMITATION OF LIABILITY & INDEMNIFICATION

By entering this Contest, Eligible Participants agree that the Contest Administrator, Contest Sponsor, the AGCO, and the Government of Ontario, and each of their respective subsidiaries and affiliates, media partners, advertising and promotional agencies, Meta, Facebook, Instagram, and each of the foregoing entities’ respective directors, officers, employees, agents, representatives, successors and assigns (the “Released Parties”) do not make any representation or warranty, or assume any liability beyond, where applicable, what has been described as the Prize in these Official Rules.

Each Eligible Participant and his/her representatives, heirs, next of kin or assignees (“Eligible Participant’s Representatives”) hereby releases and holds Released Parties harmless from any and all liability for any injuries, loss or damage of any kind to the Eligible Participant, Eligible Participant’s Representatives or any other person, including personal injury, death or property damage, resulting in whole or in part, directly or indirectly, from acceptance, possession, use or misuse of the Prize, participation in the Contest, any breach of the Official Rules, or in any Prize-related activity.

None of the Released Parties assumes any liability for any incorrect or inaccurate information, whether caused by website users or by any of the equipment or programming associated with or utilized in the Contest or by any technical or human error which may occur in the processing of Entries, the selection of winners, or for any printing or other errors in any Contest materials. The Released Parties assume no responsibility for any error, omission, tampering, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or authorized access to, or alteration of Entries. The Released Parties are not responsible for any problems, viruses or technical malfunction of any telephone network or lines, computer online systems, servers or providers, computer equipment, software, failure of email on account of technical problems or traffic congestion on the Internet or at any website or combination thereof, including injury or damage to an Eligible Participant’s or to any other person's computer related to or resulting from participating or downloading materials in the Contest.

The Eligible Participant and Eligible Participant’s Representatives agree to fully indemnify the Contest Administrator, Contest Sponsor, the AGCO and the Government of Ontario from any and all claims by third parties relating to the Contest, without limitation.

c.       PRIVACY

By entering the Contest, Eligible Participants expressly consent to the Contest Administrator, Contest Sponsor, media partners, advertising and promotional agencies, storing, sharing and using the personal information submitted with their Entry only for the purpose of administering the Contest and in accordance with the Contest Administrator’s and Contest Sponsor’s Privacy Policies publicly available at:

Contest Administrator will retain the personal information according to applicable laws.

d.      PUBLICITY RIGHTS

The contents of all Submissions become property of the Contest Administrator and will not be returned. Each Eligible Participant grants permission for Contest Administrator and Contest Sponsor to use the contents of their Submission, including name and address for editorial, advertising, marketing and promotional purposes in any and all media now known or hereafter discovered, worldwide, in perpetuity, without compensation, notification or permission.

Contest Administrator and Contest Sponsor reserve the right to: (i) use the contents of Submissions provided by Eligible Participants, for editorial, advertising, marketing and promotional purposes, without further compensation or notice, unless prohibited by law; and (ii) publish, without compensation, the full name, city of residence, and photograph of all Prize winner and Eligible Participants waive all rights with respect to printed, broadcast and other forms of publicity.

e.       MISCELLANEOUS

In the event of a conflict between these Official Rules and any instructions or interpretations of these Official Rules given by an employee of the Contest Administrator or Contest Sponsor regarding the Contest, these Official Rules shall prevail. In the event of any discrepancy or inconsistency between the terms and conditions of these Official Rules and disclosures or other statements contained in any Contest-related materials, the terms and conditions of these Official Rules shall prevail, govern and control.

The invalidity or unenforceability of any provision of these Official Rules shall not affect the validity or enforceability of any other provision. In the event that any provision is determined to be invalid or otherwise unenforceable or illegal, these Official Rules shall otherwise remain in effect and shall be construed in accordance with the terms as if the invalid or illegal provision were not contained herein.

Any words herein importing the masculine gender shall include the feminine gender and vice versa in both the singular and the plural.

f.        SOCIAL MEDIA

Eligible Participants acknowledge and agree that the Contest is not sponsored, endorsed or administered by, or associated with, Facebook or Instagram.

Each Eligible Participant and the Eligible Participant’s Representatives hereby releases and holds Meta Platforms, Inc. (doing business as Meta, Facebook, and Instagram) harmless from any and all liability for any injuries, loss or damage of any kind to the Eligible Participant, Eligible Participant’s Representatives or any other person, including personal injury, death or property damage, resulting in whole or in part, directly or indirectly, from acceptance, possession, use or misuse of the Prize, participation in the Contest, any breach of the Official Rules, or in any Prize-related activity.
