“Whisky Rocks Music Video Competition”

OFFICIAL RULES

  1. No Purchase Necessary. No purchase is required to enter this Competition. Any purchases made will not increase or influence an Entrant’s chances of winning.

    Submission Entry Period runs from September 19, 2011 at 10:01 A.M. E.S.T. to October 21, 2011 at 4.59 P.M. E.S.T.

    Competition Closing Date is November 2, 2011 at 4:59 P.M. E.S.T.

  2. How To Enter: To enter visit http://www.lcbo.com and click on the "Whisky Rocks Music Video Competition" button, between September 19, 2011 at 10:01 A.M. E.S.T. to October 21, 2011 at 4:59 P.M. E.S.T., (the “Submission Entry Period”) to download a copy of the lyrics for “Fade Away” (the “Lyrics”) and accept terms of use. Create your own music video for “Fade Away” using the Lyrics with your own original music and video. Internet access is required as all entries must be submitted online. To submit a Music Video Entry, click on the “Upload Your Video” button, fill out all required fields on the Online Entry Form (the “Entry Form”), accept all Official Rules and follow the video upload instructions. Upon clicking the “Submit” button, a confirmation message will confirm the successful receipt of an entry submitted. Only one entry may be submitted per person/group.

  3. Eligibility: This Competition is open to any resident of Ontario who is nineteen (19) years of age or older and who is not an employee, or a member of the immediate family of or domiciled with an employee of the Liquor Control Board of Ontario (the “LCBO”), the Alcohol and Gaming Commission of Ontario (“AGCO”), or of any licensees authorized by AGCO, or of their subsidiaries, affiliates or of the advertising or of promotional agencies for any of the above. Entries submitted through representatives, groups or organizations will not be accepted.

  4. Music Video Entries Requirements. Music Video Entries submitted must:

    (i) contain only the Lyrics and no other musical lyrics;
    (ii) be performed by the Entrant (see also Submission Terms below);
    (iii) be performed in English;
    (iv) be a maximum of roughly four minutes (4:00) in length;
    (v) comply with the AGCO Liquor Advertising Guidelines: Liquor Sales Licensees and Manufacturers and the CRTC Code for Broadcast Advertising of Alcoholic Beverages; and
    (vi) be submitted electronically as AVI, MOV, MP4, Quicktime, WMV or ZIP file formats via www.lcbo.com or www.whiskyrocks.com; and be contained in a digital file that does not exceed 250 MB in size.

  5. Submission Terms: By entering you agree to the following:

    Proof that you uploaded a Music Video Entry does not constitute proof or evidence that it was received within the Submission Entry Period or eligible for the Competition. The LCBO reserves the right to disqualify and/or remove any Music Video Entry in whole or in part for any reason within its sole and absolute discretion. Without limiting the foregoing, any obscene, offensive, sexual or otherwise inappropriate Music Video Entry including without limitation those referencing or depicting violence, nudity or explicit activity, or which are not in the spirit of the Competition or do not meet LCBO standards, AGCO Liquor: Advertising Guidelines, the CRTC Code for Broadcast Advertising of Alcoholic Beverages or any reason, as determined by the LCBO, will not be considered. Entries will not be returned and become the property of the LCBO.

    By entering, you represent and warrant that:

    i. your entire Music Video Entry is an original work by you (other than the Lyrics and any other any materials that may be furnished to you via this website) and you have not included third-party content (such as writing, poetry, text, graphics, artwork, logos, photographs, dialogue from plays, musical recordings, clips of videos, television programs or motion pictures) in or in connection with your Music Video Entry;

    ii. no person or entity other than you has any right, title or interest in any part of your Music Video Entry (other than the Lyrics, which have been licensed exclusively to the LCBO);

    iii. your Music Video Entry, the use thereof by the LCBO, or the exercise by the LCBO of any of the rights granted by you does not and will not infringe or violate any rights of any third party or entity, including, without limitation patent, copyright, trademark, trade secret, defamation, privacy, publicity, false light, misappropriation, intentional or negligent infliction of emotional distress, confidentiality, or any contractual or other rights;

    iv. you have all the rights, licenses, permissions and consents necessary to submit the Music Video Entry and to grant all of the rights that you have granted to LCBO hereunder; (v) you have obtained written permission when filming any subject matter on private property not owned or controlled by you, where such permission is required;

    v. you are at least nineteen (19) years old and are a resident of the Province of Ontario;

    vi. all persons who appear in the Music Video Entry in any manner:

    a. have given you their express written consent to submit the Music Video Entry for unlimited, royalty-free use, exhibition and other exploitation in any manner and in any and all media, whether now existing or hereafter discovered, throughout the world, in perpetuity;

    b. have provided written permission to include their image or pictures in or with your Music Video Entry (or if a minor who is not your child, you must have the permission of their parent or legal guardian) and you may be asked by the LCBO to provide permission in writing; 

    c. have no claims for payment of any kind, including, without limitation, for royalties or residuals, has no approval or consultation rights or any rights of participation arising out of any use, exhibition or other exploitation of the Music Video Entry; and

    d. were not under any union or guild agreement that results in any ongoing obligations resulting from the use, exhibition or other exploitation of the Music Video Entry; and

    vii. you understand, recognize and accept that the LCBO has access to, may create or has created materials and ideas which may be similar or identical to the entry in concept, theme, idea, format or other respects. In the event that your entry is identical or similar to the entry of another Entrant, the LCBO reserves the right to score one entry higher than the other subject to the judging criteria set forth below and at the sole discretion of the Judging Panel.

    By entering, you agree that:

    i. all Music Video Entries become the LCBO's property and will not be returned;

    ii. if your Music Video Entry is selected to appear on the lcbo.com website (as more fully described in Section 7- Judging Criteria), the Music Video Entry, together with your name and description of the Music Video Entry provided will be posted on www.lcbo.com, www.whiskyrocks.com or such other website(s) as may be determined by the LCBO, and you consent to the release of your Music Video Entry, name and Video description and the posting of such information by the LCBO on lcbo.com, www.whiskyrocks.com or such other website(s) as may be determined by the LCBO;

    iii. proof of originality must be supplied to the LCBO upon request, and any Music Video Entry found to infringe someone else's copyrights will be immediately disqualified from the Competition;

    iv. the LCBO (and its authorized representatives) have the unlimited right to alter and/or edit the Music Video Entry or any part or element thereof; and

    v. the LCBO and their licensees, successors and assigns have the right to use any and all Music Video Entries, and the names, likenesses, and images of all persons appearing in the Music Video Entry, for any purpose relating to this Competition.

    At the time you send any Music Video Entry, in whole or in part, to the LCBO, and whether or not your Music Video Entry is selected as a winner, you irrevocably grant to the LCBO, a perpetual royalty free, world wide, non-exclusive license to use your Music Video Entry for any purpose whatsoever connected to the Competition. If your Music Video Entry is selected as the Grand Prize winner, you agree that such license shall automatically extend to include any and all uses of the Music Video Entry by the LCBO including for future advertising, promotion and publicity in any manner and in any medium now known or hereafter devised throughout the world in perpetuity. You will not now nor in the future be paid for your Music Video Entry or for granting the LCBO any of these rights. The LCBO, its affiliates, licensees, successors and assigns are in no way obligated to use or continue to use your Music Video Entry (and have no obligation to you or any other person or entity after your Music Video Entry is received). You agree to waive all claims to and shall receive no royalties of any kind now or in the future from the LCBO, its affiliates, licensees, successors and assigns for use of your Music Video Entry including copyright, trademark, public performance, digital sound recording, mechanical, synchronization or master use royalties, and you represent, warrant and agree that no other party is entitled to claim royalties from the use of the Music Video Entry as set forth in these Official Rules.

    Please also be aware that your Music Video Entry may not be acknowledged and will not be received or held "in confidence" and your Music Video Entry does not create a confidential relationship or obligation of secrecy between you and any of the entities involved in this Competition. You recognize that other persons may have provided the LCBO or others, or made public, or may in the future submit, or make public, materials that are same or similar to your Music Video Entry. You acknowledge and agree that the LCBO shall have the right to use such same or similar materials, and that you will not be entitled to any compensation arising from the LCBO’s use of such materials.

    By entering, you acknowledge that you have read, understood, accept and agree to be bound by the terms and conditions of these Official Rules, as they may be amended from time to time. You may not resell, assign or transfer any of your rights under these Official Rules. Entries that do not comply with all requirements stated in these Official Rules will not be considered and will be disqualified.

  6. Prizes:

    There is one (1) Grand Prize to be awarded for the “Whisky Rocks Music Video Competition” winner.

    One (1) Grand Prize Pack consisting of one (1) full day in the Vespa Studio in Toronto (same studio as in the video where Ian recorded Fade Away.) Winner will be in the studio with Ian Thornley as producer & his engineer Eric Ratz (also seen in video). (Approx. retail value is $10,000 Cdn.).

    The odds of winning depend upon the number and quality of Music Video Entries received. Prizes must be accepted as awarded. Prizes are non-transferable and not redeemable for cash. The LCBO reserves the right to substitute any prize with one of equal or greater value.

    Potential winners will be notified by telephone or email on or around November 18, 2011. To win, a selected Entrant must have complied with the Official Rules and sign a release and discharge of liability document in a form acceptable to LCBO releasing the LCBO, its directors, officers, employees and agents from all liability of any kind in connection with the Competition. If a potential winner cannot be contacted within 7 days after initial attempt to contact, the prize will be awarded to the next qualified Music Video Entry with the next highest judging score from the top five (5) finalists. All decisions of the LCBO are final.

    The winner of the Grand Prize must redeem their prize before December 31, 2011.

  7. Judging Criteria:

    All qualifying Music Video Entries, determined at the sole discretion of the LCBO, will be posted on www.lcbo.com, www.whiskyrocks.com or such other website(s) as may be determined by the LCBO, updated on a regular basis during the Submission Entry Period.

    An online public vote to choose the top five (5) finalists will take place at the lcbo.com website from October 21, 2011 at 5:01 P.M. E.S.T. and conclude on November 2, 2011 at 4:59 P.M. E.S.T. (the “Public Voting Period”). During the Public Voting Period, each person will have the opportunity to vote once per day from the submitted entries, resulting in top (5) finalists (based on number of votes). The top five (5) finalists will then be presented to a professional Judging Panel to determine the Grand Prize Winner. The top five (5) finalists will be posted on www.lcbo.com, www.whiskyrocks.com or such other website(s) as may be determined by the LCBO, on or around November 2, 2011 at 5 P.M. E.S.T.

    On or around November 14, 2011, a professional panel of five (5) judges, chosen by the LCBO, will select the Winner based on the following criteria: 1) Commercial Applicability, 2) Song Composition, 3) Musicality, 4) Image and Style and 5) Star Factor. All Music Video Entries must also meet guidelines set out by the AGCO for advertising of beverage alcohol as well as the Code for Broadcast Advertising of Alcoholic Beverages. The LCBO reserves the right not to consider any Music Video Entries, which in its sole determination, do not meet such guidelines. The Music Video Entry selected by the panel of judges will be declared the Grand Prize Winner. All decisions of the judges are final. Selected Winner and its Music Video Entry are subject to verification and must have complied with the Official Rules.

  8. RELEASE: BY UPLOADING A MUSIC VIDEO ENTRY AND SUBMITTING A COMPLETED ONLINE ENTRY FORM, YOU RELEASE THE LCBO, ITS DIRECTORS, OFFICERS, EMPLOYEES AND AGENTS FROM ANY AND ALL LIABILITY ARISING OUT OF OR IN CONNECTION WITH THIS COMPETITION AND THE AWARDING OF ANY PRIZE, NOW OR IN THE FUTURE.

  9. Disclaimer: The LCBO reserves the right to suspend, cancel or modify the Competition at any time if it determines that for any reason the Competition cannot be run as originally planned or if fraud or any other occurrence compromises the fairness or integrity of the Competition. If for any reason this Competition is not capable of running as planned due to an infection by a computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes beyond the control of the LCBO which corrupt or affect the administration, security, fairness, integrity, or proper conduct of this Competition, the LCBO reserves the right, in its sole discretion, to (i) disqualify any individual who tampers with the entry or voting process; (ii) disqualify any Music Video Entry for violation of the voting rules; or (iii) to cancel, terminate, modify or suspend the Competition. The LCBO assumes no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to, or alteration of, entries. The LCBO is not responsible for any problems or technical malfunctions of any telephone network or telephone lines, computer on-line systems, servers, or providers, computer equipment, software, failure of any E-mail or entry to be received by the LCBO due to technical problems, human error or traffic congestion on the Internet or at any web site, or any combination thereof, including any injury or damage to Entrant's or any other person's computer relating to or resulting from participating in this Competition, uploading or downloading any materials in this Competition. The LCBO is not responsible for any actions taken by any individual who downloads any Music Video Entries from www.lcbo.com, www.whiskrocks.com, or such other website(s) as may be determined by the LCBO and uses it for any purposes, legal or illegal, according to any and all laws. Once submitted, a Music Video Entry cannot be modified, deleted or cancelled. CAUTION: ANY ATTEMPT TO DELIBERATELY DAMAGE ANY WEB SITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE COMPETITION IS A VIOLATION OF CRIMINAL AND FEDERAL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, THE LCBO RESERVES THE RIGHT TO SEEK DAMAGES OR OTHER REMEDIES FROM ANY SUCH PERSON (S) RESPONSIBLE FOR THE ATTEMPT TO THE FULLEST EXTENT PERMITTED BY LAW. In the event of a dispute as to the identity or eligibility of a Winner based on an E-mail address, the winning entry will be declared made by the "authorized account holder" of the E-mail address submitted at the time of entry. "Authorized account holder" is defined as the natural person nineteen (19) years of age or older who is assigned to an E-mail address by an Internet access provider, on-line service provider, or other organization (business, educational institution, etc.) that is responsible for assigning E-mail addresses for the domain associated with the submitted E-mail address. Uses of automated devices are not valid for entry or voting. Entries that are mechanically reproduced, fraudulent, illegible, mutilated or tampered with will be declared invalid.

  10. Declaring Grand Prize Winner and Awarding Prize Each Entrant who is declared as a potential Grand Prize Winner will be required to sign a document in a form acceptable to the LCBO confirming compliance with these rules and releasing the LCBO, their directors, officers, employees and agents from all liability of any kind in connection with the Competition or occurring as a result of the prize being awarded. This document will be mailed to prospective Grand Prize Winner and must be received at the return address within 10 days after it is mailed to the prospective Winner or the prospective Winner will be disqualified.

    The LCBO will share the name of the Winner with recording studios, label records, agents and photographers for the purposes of prize fulfillment. The Grand Prize must be redeemed by December 31, 2011.

    The LCBO is not responsible for any change of address of an Entrant, or inability to deliver a prize, or lost, late, incomplete, destroyed, stolen or misdirected mail or entries that have been tampered with.

  11. Miscellaneous: By entering the Competition, you agree to abide by and be bound by these Rules and Regulations, which are final. By entering, the Entrants agree that the LCBO may post their Music Video Entry on www.lcbo.com, www.whiskyrocks.com or such other website(s) as may be determined by the LCBO, and use their name, address, and likeness in any matters related to this Competition, including any advertising or publicity, without compensation or further consent. The LCBO accepts no responsibility for losses, damages or claims caused by or resulting from any prize. Correspondence will be entered into only with prize claimants. This Competition is subject to all applicable federal, provincial and municipal laws.

  12. Privacy: The personal information on the Online Entry Form is collected under the authority of para. 3(1)(n) of the Liquor Control Act, R.S.O. 1990, c. L.18, for the purpose of administering this Competition. By submitting an Online Entry Form, each Entrant consents to the collection, use and disclosure indicated above.
