“In Style” Contest

CONTEST RULES & REGULATIONS

The contest is conducted by the Wine Institute of California and the California Travel & Tourism Commission. The contest begins April 30, 2008 at 12:01 p.m. and ends May 30, 2008 at 11:59 p.m. (the “Contest Period”). The contest is intended for Ontario residents only and is governed by Canadian law.

Eligibility
No purchase is necessary. To be eligible to enter and win, the entrant must be of legal drinking age (19 years or older) at the time of entry and a resident of Ontario and not be a) an employee of the Liquor Control Board of Ontario (“LCBO”), the Wine Institute of California (“Sponsor”), their respective advertising and promotional agencies or the independent contest organization; b) an employee of the Alcohol and Gaming Commission of Ontario (“AGCO”), or of any licensees authorized by AGCO; or c) a member of the immediate family, or a person who is domiciled with any of the above persons.

Prize Description
Four prizes are available to be won, as follows: a) Two prizes of a trip for two to San Francisco/Napa Valley or Sonoma County (the “San Francisco Prizes”) and , b) two prizes of a trip for two to Los Angeles/Santa Barbara County (the “Los Angeles Prizes”) . Each prize consists of:

  • Two Hospitality Class return flights to San Francisco (for the San Francisco Prizes) or Los Angeles (for the Los Angeles Prizes) from Toronto or Ottawa
  • 4 nights four star, double occupancy accommodations in San Francisco/Napa or San Francisco/Sonoma (for the San Francisco Prizes) or in Los Angeles/Santa Barbara County (for the Los Angeles Prizes)
  • $100/meal voucher per day/couple
  • Limo wine tour to three wineries
  • Four nights premium car rental
  • Spa package for two
  • A VIP City Pass in Hollywood (for the Los Angeles Prizes) or San Francisco (for the San Francisco Prizes)- passes to upscale and exciting attractions
  • Additional tickets to attractions, shows etc.
  • Transportation to and from departing airport, travel insurance, passport costs, excess baggage costs and airport improvement costs are NOT provided.

Travel must take place between October 20th, 2008 and April 30th, 2009. Travel dates to be determined with the Wine Institute of California. Some date restrictions and blackout periods may apply. Each winner and guest must travel together on the same itinerary. Trip must be booked by 60 days in advance. All expenses not set out above, including, without limitation, transportation to and from the departing airport, any meals not specified above, all alcoholic beverages, gratuities, health insurance, items of a personal nature and service charges are the sole responsibility of the individual winner. Each winner and his/her guest must be free of any restrictions on their ability to travel as contemplated by these official rules. It is the sole responsibility of the winner and his/her guest to obtain travel insurance, health insurance, and all required travel documents (including a valid passport or visa), if applicable. Sponsor will not be responsible in the event that the winner and/or his or her guest are denied entry into the destination country, or re-entry to Canada. In such an event, the winner and/or his/her guest will be solely responsible for any and all costs incurred, and the prize may be forfeited. Estimated retail value of each prize is $ 5,000 CAN.

Prizes must be accepted on an “as is” basis. No substitution prizes will be awarded. However, Sponsor reserves the right to substitute a prize of equal or greater value without notice. If the selected entrant cannot use or chooses not to use any portion of the prize, that portion of the prize will be deemed to be forfeited and no substitution or other compensation will be awarded. Prize is not transferable or otherwise redeemable for cash. Prizes will only be released to the verified winners. Return of any prize/prize notification as undeliverable may result in disqualification and selection of an alternate winner.

How To Play
To enter, visit any participating LCBO outlet between April 30 – May 25, 2008 to obtain a contest piece available on select California wine products (while supplies last). Scratch the play area to reveal a unique alphanumeric number. Keep the contest piece and log on to the LCBO website at www.lcbo.com from April 30 – May 30, 2008. Click on the ‘Visit California “In Style” Contest’ link and fill in all required fields on the entry form including the unique number found on the contest piece. Click “Enter” to be entered for a chance to win one of the four (4) Prizes. Entry must be received on or before 11:59 p.m. on May 30, 2008. Entries generated by script, macro or other automated means are void.

Contest pieces are also available by mailing, with sufficient postage, a request in writing and a postage paid, self-addressed envelope to the following address: The Wine Institute of California, 1100 Burloak Drive, Suite 300, Burlington, On L7L 6B2. Supplies are limited. Requests must be received by May 16, 2008 to allow for timely processing and return. Only one request per envelope.

Prize Draw
A random draw from all eligible entries will be held on or about June 11, 2008 in Toronto, Ontario by an independent contest organization whose decision is final. The chances of winning depend on the total number of eligible entries received. In order to win, the selected entrant must have complied with the rules and will be required to correctly answer unassisted a time-limited, arithmetic skill-testing question by telephone at a pre-determined mutually convenient time. A selected entrant may be disqualified and the prize awarded to an alternate entrant (selected and subject to disqualification in the same manner) if: (a) the selected entrant cannot be reached within five (5) business days of the draw; (b) any prize/prize notification is returned as undeliverable; (c) the selected entrant fails to prove eligibility or to otherwise comply with these official rules; or (d) the selected entrant fails to answer the skill-testing question correctly or to return the Declaration and Release (defined below) within the specified deadline. No more than one prize per person or per household or per emailing address with be awarded.

Before being declared a winner, the selected entrant and his/her guest will be required to sign a standard document confirming compliance with the contest rules, acceptance of the prizes as awarded and a release of liability (“Declaration and Release”) in a form acceptable to the Sponsor and the LCBO, releasing from liability the Wine Institute of California, the California Travel & Tourism Commission (prize supplier) and the LCBO and all of their respective directors, officers, employees, agents and affiliates (collectively, the “Releasees”) from any liability in connection with this Contest or the prize. Declaration and Release documents must be returned within the time period indicated in the documents or the prize may be forfeited. Prize winner’s guest must also sign and return a Declaration and Release form prior to travel, and name of guest may not be changed once the Declaration and Release form has been received by Sponsor or its agent. Entrants assume all liability for injuries caused or claimed to be caused by participation in this Contest, or the use or misuse of any prizes(s) awarded therein.. The winners agree to the use of their names and likeness in any related publicity without compensation. The contest is subject to all applicable federal, provincial and municipal laws. By entering the contest, entrants agree to abide by the contest rules and decisions of the independent contest organization, which are final. No correspondence will be entered into except with the selected entrants, who will be contacted by mail or phone.

GENERAL CONDITIONS:

The LCBO and AGCO are not connected to this contest in any manner whatsoever and are not liable in any way for any matter related to this contest.

All entries become property of the LCBO upon receipt and will not be returned. The decisions of the Sponsor or the independent contest organization will be final and binding on all entrants. Neither the LCBO nor the Sponsor assumes any responsibility for lost, stolen, delayed, damaged or misdirected entries or for any failure of the contest website during the promotional period, for any problems or technical malfunction of any communications network or lines, computer on-line systems, servers, access providers, computer equipment, software, failure of any e-mail or entry to be received by the Sponsor or the LCBO on account of technical problems, human error or traffic congestion on the Internet or at any website or any combination thereof including any injury or damage to an entrant’s or any other person’s computer related to or resulting from playing or down loading any material in the promotion. The Sponsor and the LCBO each reserve the right, in its sole discretion, to cancel or suspend this contest should a virus, bug or other cause beyond the reasonable control of the Sponsor or the LCBO corrupt the security, fairness, integrity or proper administration of the contest. Any attempt to deliberately damage any web site or to undermine the legitimate operation of this promotion is a violation of criminal and civil laws, and should such an attempt be made, both the Sponsor and the LCBO reserve the right to seek remedies and damages to the fullest extent permitted by law, including criminal prosecution. Contest pieces and entries are subject to verification and will be declared invalid if they are illegible, mechanically reproduced, not legitimately obtained, mutilated, forged, falsified, altered or tampered with in any way. Subject to applicable law, the Sponsor and the LCBO each reserve the right to withdraw, amend or terminate this Contest at any time without prior notice and reserves the right to cancel this contest at any time because of any printing or other error, or if it suspects or finds evidence of tampering with any part of the contest. In the event of a dispute as to who submitted an entry, the entry shall be deemed submitted by an “authorized e-mail account holder” and entries will be declared made by the authorized e-mail account holder of the e-mail address submitted at the time of entry. “Authorized e-mail account holder” is defined as the natural person who is assigned to an e-mail address by an Internet access provider, on-line service provider, or other organization (e.g., business, educational institution etc.) that is responsible for assigning e-mail addresses for the domain associated with the submitted e-mail address. The potential winner may be requested to provide Sponsor with proof that the potential winner is the authorized account holder of the e-mail address associated with the potentially winning entry.

The personal information on the entry form is collected under the authority of section 3(1)(n) of the Liquor Control Act, R.S.O. 1990, c.L.18 for the purpose of administering this contest. The personal information of the selected entrants will be disclosed to the Sponsor for the purpose of prize fulfillment. By submitting an entry form, each entrant consents to the collection, use and disclosure of their personal information for the purposes indicated above.
